Terms of Use

These terms govern your use of the CARER app and website.
Please read them carefully before you use CARER.

1. Accepting these terms

These Terms of Use ("Terms") are a legal agreement between you and Wellnetix Ltd ("Wellnetix", "we", "us"), a company incorporated in the United Kingdom. They govern your access to and use of the CARER mobile app and the CARER website (together, "CARER").

By creating an account, downloading the app, or using any part of CARER, you agree to these Terms. If you do not agree, do not use CARER.

Our Privacy Notice is incorporated into these Terms by reference.

2. Who can use CARER — eligibility

CARER is for adults aged 18 and over, anywhere in the world. By using CARER you confirm that you are at least 18 years old.

CARER is designed for the unpaid carer — the person doing the caring. It is not designed for, and must not be used to monitor, surveil, profile, or make decisions about, the person being cared for. The cared-for person's condition, medications, symptoms, and care are outside the scope of CARER.

If you are under 18 and caring for someone, CARER is not for you — but there are services built specifically for young carers. CARER will point you to them.

Your use of CARER must be lawful in your country or territory. If using CARER is not permitted where you live, please do not use it. It is your responsibility to ensure your use complies with the laws that apply to you.

3. What CARER is and is not

Understanding what CARER is and is not matters. These are not small-print disclaimers — they are the honest description of the product.

CARER is:

  • A non-clinical wellbeing companion for unpaid family carers.
  • A private space to be heard, to hold difficult feelings, and to be remembered — in your own words.
  • A route to free crisis and safeguarding resources, one tap away — tailored to your region inside the app.
  • A tool to help you feel less alone and to signpost you toward human help when you need it.

CARER is not:

  • A medical service, medical device, or regulated health product. It does not diagnose, treat, monitor, screen, or assess anyone's mental or physical health.
  • A therapy or counselling service. CARER is not a substitute for professional mental health support, psychotherapy, or clinical care.
  • An emergency service. CARER cannot contact emergency services on your behalf. In an emergency, call your local emergency services.
  • A source of medical or clinical advice about the person you care for — or about yourself. Any such questions will be respectfully redirected to qualified professionals.
  • A care-coordination or task-management tool. CARER does not manage rotas, medications, appointments, or care plans.

You must not rely on CARER for medical, clinical, or emergency decision-making. If you are concerned about the health or safety of yourself or anyone else, please contact a qualified professional or the emergency services.

4. In an emergency

If you or someone else is in immediate danger, call your local emergency services immediately — 999 in the UK, 911 in the US and Canada, 112 across Europe and many other countries.

If you need urgent emotional support, Find A Helpline (findahelpline.com) connects you to free, confidential crisis services in 175+ countries. In the UK specifically:

  • Samaritans — 116 123 (free, 24/7)
  • Shout — text SHOUT to 85258 (free, 24/7)
  • NHS 111 — press option 2 for mental health, 24/7

See our Get urgent help page for worldwide and country-specific crisis resources. These are always free and accessible from within the CARER app, even without an account or an internet connection.

CARER includes a crisis and safeguarding route that is always one tap away. It does not replace emergency services — it helps you find the right one.

5. Your account

You may use some parts of CARER (including the crisis resources) without an account. To use the companion, memory, and backup features, you will need to create an account.

You are responsible for keeping your account credentials secure. Please notify us at nimind@wellnetixltd.com if you believe your account has been compromised.

You may not create an account on behalf of someone else or share your account with another person.

6. Your responsibilities

When you use CARER, you agree to:

  • Provide accurate information about yourself.
  • Use CARER only for your own personal, non-commercial use as an unpaid carer.
  • Not attempt to circumvent any age gate, consent gate, or safety feature.
  • Not use CARER to harm, harass, or monitor any other person — including the person you care for.
  • Take responsibility for your own decisions. CARER can support you, but it is not a substitute for your own judgment, or for professional advice.

7. Acceptable use

You must not:

  • Use CARER for any unlawful purpose or in breach of any applicable law.
  • Attempt to reverse-engineer, decompile, or extract the source code of the CARER app.
  • Introduce malware, viruses, or any harmful code.
  • Attempt to gain unauthorised access to our systems or another user's account.
  • Scrape, mine, or harvest data from CARER.
  • Use CARER in any way that could damage, overload, or impair its availability.
  • Impersonate any person or entity.

8. Your content — your words

You own your words. The conversations you have and the memories you save in CARER remain yours. We do not claim any ownership over the content you share.

By using CARER, you grant Wellnetix a limited, non-exclusive, royalty-free licence to store, process, and display your content solely for the purpose of providing the CARER service to you. This licence ends when you delete your content or close your account.

We will not use your content for advertising, sell it to anyone, or share it with third parties except as set out in our Privacy Notice. We will not use it to train AI models.

If you wish to contribute to research or product improvement (which is currently not available), any such use would require a separate, explicit opt-in consent — entirely independent of these Terms and entirely optional. See our Privacy Notice §6.

9. Our intellectual property

CARER, including its design, software, text, graphics, and the brand name and logo, is owned by Wellnetix Ltd or its licensors and is protected by intellectual property law. Nothing in these Terms transfers any intellectual property rights to you.

You may use CARER for your personal use as described in these Terms. You may not copy, reproduce, distribute, or create derivative works from any part of CARER without our written permission.

10. Availability

We aim to keep CARER available and working well. However, we provide CARER "as is" and "as available". We do not guarantee that:

  • CARER will be available at all times or without interruption.
  • CARER will be free of errors or bugs.
  • Any particular feature will remain available — features may be added, changed, or removed as CARER develops.

The crisis and safeguarding resources within CARER are maintained and versioned, but you should always have an alternative way to reach emergency services (such as a phone or other device).

11. Disclaimers and limitation of liability

To the fullest extent permitted by applicable law:

  • CARER is provided as a wellbeing companion, not a medical or clinical service. We disclaim any liability for clinical or medical outcomes arising from use of CARER.
  • We are not liable for any indirect, incidental, special, consequential, or punitive loss or damage arising from your use of CARER, including loss of data, loss of profit, or emotional harm — except to the extent that such loss arises from our negligence, fraud, or wilful misconduct.
  • Where we are liable, our total liability to you in any 12-month period will not exceed the greater of (a) the amount you paid for CARER in that period, or (b) £100.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot lawfully be excluded or limited under the laws of England and Wales, including the Consumer Rights Act 2015.

12. Your consumer rights

If you are a consumer in the United Kingdom, you have statutory rights that these Terms do not affect. The Consumer Rights Act 2015 gives you rights in respect of digital content that is faulty or not as described. Nothing in these Terms is intended to override those rights.

If you are based outside the United Kingdom, you may have additional or different consumer rights under the laws of your country. These Terms do not affect any rights you have under your local law that cannot lawfully be excluded or limited.

Note to owner: these Terms are governed by England and Wales law but CARER is now available globally. A solicitor review is recommended before public launch to confirm whether additional jurisdiction-specific terms (e.g. EU consumer law, US state laws) are required.

13. Termination

You may stop using CARER and close your account at any time. See our Privacy Notice §10 for how your data is handled on deletion.

We may suspend or terminate your access to CARER if you breach these Terms, or if we are required to do so by law. In any event, your crisis and safety features will remain accessible for a reasonable period following termination.

On termination, your licence to use CARER ends, but any provisions that by their nature should survive (including §11, §14, and our rights in §9) will do so.

14. Governing law

These Terms are governed by the laws of England and Wales. Any dispute arising from them will be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in the courts of your home country.

Note: The owner may wish to confirm whether England and Wales is the preferred jurisdiction, or whether a different choice is needed for any future B2B partnerships.

15. Changes to these terms

We may update these Terms as CARER develops. For material changes, we will notify you via the app at least 14 days before the change takes effect, giving you the opportunity to review and — if you do not agree — to close your account. The "Last updated" date at the top of this page shows when these Terms were last revised.
